A Meeting of the above named Council convened by the Council was held in the Oak Room, Thornborough Hall on Monday, 17th June 2013 at 7.00pm.

A short presentation was given by Bob Owen about the North Yorkshire homelessness project. If someone is found rough sleeping then the 'Streetline' charity can be contacted on 0300 500 0914. Cllr Walker thanked Mr Owen for his useful presentation.


Mr Shepherd complained about the minutes of the May Meeting that he had read in Leyburn Life and said that these were not a record of what he had said. He suggested that ratepayers wishing to raise issues in Public Representations could send their points in advance in written form so that Councillors could prepare answers before the meeting.

2798. APOLOGIES were received from Cllr Warland and District Cllr Duff.

2799. To receive any Declaration of Interest under the Council's Code of Conduct or Members' Register of Interests.

Cllr Bell declared an interest in planning item 7(h).

2800. MINUTES OF MEETING held on Monday, 20th May 2013 were approved as a correct record.


The Police had informed the Town Council about the new sign at Harmby railway bridge asking drivers to pull up right up to the line in order to trigger the traffic lights. This is a temporary measure and depending on its success, the sign may remain in place or the lights will be put onto a timed changeover.

The Clerk responded to Mr Shepherd's comment at the previous meeting in which he accused the Town Council of not running Thornborough Hall in the correct legal manner. The Clerk had checked this with the Council's legal advice service and confirmed that the Hall is run in accordance with the law and Mr Shepherd's comments were incorrect.

NYCC Highways had responded to the complaints about the tourist sign at the Middleham Road junction directing people to the Chocolate Factory. There is no other suitable location for the sign and they felt that it is pointing in the correct direction. Councillors will check the sign again.

The Clerk has chased up the replacement black metal finger post for the toilets with NYCC and they will contact the manufacturer about this.


Cllr Bainbridge had attended the Portas Town Team Meeting. The group needs more members, especially members of the public. The next meeting will be held in September.

Decision/Comment Required

a. Cllr Robinson was selected as the Tour De France Town Council representative for future meetings of the local organizing group for the event. Cllr Bainbridge would act as back-up for meetings.

b. Spennithorne & Harmby Sports Association - Councillors granted permission to hold a car boot sale on 25th August at Ferrand Park, Harmby.

c. Councillors gave approval to pay the agreed donation of £500 to the 'TOSH' (the Old School House) project since work is now underway.

d. Richmondshire Leisure Trust – Councillors discussed the request for a donation towards the Colburn Leisure Centre. Some Leyburn people use the facilities there but it was agreed to find out how many local people go there, how old they are and what activities they do and then discuss the request again at the next meeting. Councillors felt strongly that there is a lack of facilities for young people in Leyburn and Cllr Denison volunteered to find out what young people would ideally like to have in the town.

e. Crime Commissioner's Community Fund Project – Cllr Waites gave an outline of the project and it was agreed to find out the cost of installing a skatepark such as the one at Thirsk.

e. 13/00218/AORM Approval of reserved matters for erection of 2 dwellings and associated infrastructure at land adjoining South View. Granted

f. 13/00305/FULL Full planning for conversion of redundant farm building to form camping barn at agricultural barn, Wensley Road.

g. 13/00228/Full Full planning for construction of two storey extra care development and 7 elderly persons bungalows with associated parking and landscaping at land north west of Cliff Lodge, Harmby Road.

h. 13/00307/Full Full planning for extension and alterations to existing single storey domestic outbuildings to form ancillary accommodation to main house, 1 Shawl Terrace.

i. 13/00312/Full Full planning for the installation of ground mounted solar PV panels in the garden at Rock Castle, Moor Road.

Comments had been made re. item (f) above: Councillors were concerned about the term 'interim' used on the application and suspected that the next application would be for a house. If this was the case then it was hoped that a Section 106 Agreement would be put in place.

Comments made re. item (g) included the need for a pelican crossing for the residents, the lack of good street lighting there, the lack of a pavement on the south side of the main road at that location, the need for traffic calming measures if the project goes ahead, the need for a room within the facility for use by visiting opticians, chiropodists etc. It was felt that there was no need for a shop since local businesses will deliver things.

Comments re. item (h) were that full planning permission should be sought if the owners wished to use the extended and altered buildings for commercial or letting purposes.

2805. MARKET
Decision/Comment Required

a. Mr J Pardoe of Leeds was granted a permanent pitch on the market to sell footwear.

b. Councillors discussed the selling of fast food and drinks at Leyburn Friday Market. The Council occasionally receives applications from traders but these are normally rejected. Reasons are the smell, the nuisance to adjoining stalls, litter, the control of hygiene is difficult and finally, safeguarding the character of the weekly market. However, it was greed that applications can continue to be brought to Meetings for consideration.


a. Public inspection of the annual accounts is by appointment from 17th June to 12th July.

b. Councillors approved the accounts as attached.

c. Councillors approved the Town Council's Annual Return for 2012 - 13.


Cllr Parry had attended a recent meeting at which Middleham's Richard III celebrations were discussed. The three years of the Leader funding would soon end and the Lower Wensleydale project needed to be sustainable and self-funding, preferably with someone part time to maintain the website.


Cllr Parry had been asked by a resident of Brentwood if the 20mph speed limit could be painted on the road.

Cllrs Parry and Denison had both visited the cemetery, which looked tidy and had very little litter. The top flower border behind the road wall requires more bushes planting in the area where the old entrance gate used to be. The block-paved area requires weeding.

Cllr Bell noted that the dropped kerb in front of the chemist's shop is so low that cars are overhanging the pavement instead of stopping further back. The poor state of the disabled signage on the parking spaces will be reported to Highways.

The grass verge below the dentists' surgery needs cutting, this has already been reported to Highways.

Cllr Waites was concerned about the uneven surface of Grove Square.

The railings near the cemetery handgate and on the Mount need painting. Highways will be informed.
